Abstract
Mary Libby Payne served on the Mississippi Court of Appeals from its creation in 1995 until her retirement in 2001. She was also the founding Dean of the Mississippi College School of Law in 1975 and a professor there from 1978 until 1994. The collection consists primarily of files related to her time on the Court of Appeals with additional material on her publications and her tenure at Mississippi College.

Biographical Note

Mary Libby Payne was born on 27 March 1932 in Gulfport, Mississippi to Reece O. and Emily Augusta (Cook) Bickerstaff. Payne was the granddaughter of Joseph Anderson Cook, the first president of the University of Southern Mississippi. Her father was an attorney and a member of the state legislature.

Payne entered the Mississippi University for Women to study ballet but felt a religious calling to practice law. She transferred to the University of Mississippi, completing her Bachelor of Arts degree in 1954. Payne earned her law degree from the University of Mississippi in 1955, graduating first in her class after serving as Casenote Editor for the Mississippi Law Journal and chair of the Moot Court Board.

Following a brief period in her father’s Gulfport law firm, Payne found that no other firm would hire a woman so she became a secretary in a title insurance company. In 1963, she opened a solo practice in Brandon, Mississippi, and Mississippi Speaker of the House Walter Sillers hired her to draft legislation. From 1968 to 1970, Payne served as executive director of the Mississippi Judiciary Commission. When the legislature created the House Drafting Office in 1970, she became its first Chief of Drafting and Research, a position she held until 1972 when she received an appointment as assistant state attorney general.

Payne was the founding dean of the Mississippi College School of Law in 1975, stepping down in 1978 to serve full time as a professor until 1994. The Mississippi Association for Women in Higher Education named her “Woman of the Year” in 1989.

Upon the creation of the Mississippi Court of Appeals in 1995, Payne succeeded in winning an election against four contestants for a short term ending in January 1999 (terms for the first set of judges on the court were staggered). She had no opponent during her reelection campaign. During her tenure, Payne was the only woman on the bench. In 1998, she helped to initiate Mississippi’s Task Force on Gender Fairness with a mission to identify whether the design, operation, laws, rules, practices and conduct of the judicial system result in inequality between men and women and to educate the bench, bar, and public about gender fairness. Upon announcing her retirement from the court in 2001, she noted that her most significant opinions were her dissents, many of which were later adopted by the majority upon appeal to the state Supreme Court.

In 2003, she returned to Mississippi College School of Law as a scholar in residence and professor emerita, publishing A Goodly Heritage: A Memoir of Mississippi College School of Law in 2011. That same year, the college created the Mary Libby Payne Endowed Lectureship on Christianity and the Law “dedicated to celebrating her lifelong commitment to modeling the integration of faith with legal ethics and professionalism.”

She was secretary and president of the Rankin County Bar which she helped to organize in 1965, a member of the Mississippi Bar (serving twice on its Board of Bar Commissioners and receiving its Lifetime Achievement Award in 2005), and a member of the American Bar Association (becoming a Fellow in 1988). Governor William Winter appointed her to his Judicial Nominating Commission. Payne served on the national board of directors for the Christian Legal Society from 1992 to 2001, receiving it Lifetime Achievement Award in 2002. A charter member of the Mississippi Women Lawyer Association, she wrote its constitution and received its Lifetime Achievement Award in 2010. In 2011, Governor Haley Barbour awarded her the Mississippi Medal of Service for significant contributions to the state.

Payne was counsel for the Christian Action Committee of the Rankin Baptist Association of Pearl from 1968 to 1992; a founder and member of the board of directors of the Christian Conciliation Service in Jackson between 1983 and 1993; and a member of the board of directors for the Exchange Club’s Child Abuse Prevention Center of Jackson from 1999 to 2001.

Payne is married to Bobby R. Payne, and they are the parents of two sons, Reece Allen Payne and Glenn Russell Payne. The couple are active members of the McLaurin Heights Baptist Church in Pearl.

The Mary Libby Payne Collection primarily contains documents related to her time on the Mississippi Court of Appeals from 1995 until her retirement in 2001. However, the files also include material related to her tenure at the Mississippi College School of Law as dean and professor as well as files related to her professional activities and publications. The collection is open to the public. However, due to privacy concerns the contents of Box 17 are restricted. Folder 17-1 with information on campaign loans will remain closed until 2037. Folder 17-2 has law clerk applications with school transcripts. The contents will remain closed to researchers in order to abide by the Family Educational Rights & Privacy Act (FERPA). If requested, the Political Papers Archivist will provide researchers with general information drawn from the files as long as the data does not violate FERPA protections.

The Mary Libby Payne Collection is stored at an off-site facility, and researchers must contact Archives & Special Collections at least two business days prior to their intended visit to arrange for the transfer of requested boxes.

Judge Payne donated her collection to the University of Mississippi in April 2012.
